Terms of Service
These Terms and Conditions govern your access to and use of Anested Cloud. Please read them carefully — by creating an account or purchasing any service you agree to be bound by everything below.

1. Definitions
- “Anested Cloud”, “we”, “us”, “our” — the Anested Cloud platform operated by Anested, 5th Floor, Maurya Lok, Near Dak Bunglow Chowk, Patna 800001, Bihar, India.
- “You”, “Customer”, “User” — any person or entity that registers an account or uses any Service.
- “Services” — all products offered on the platform, including Cloud VPS, Web Hosting, Managed Databases (MySQL, PostgreSQL, MongoDB), Nest Storage and file serving, AI Chatbots, Web Analytics, and DNS management.
- “Session” / “Billing Period” — the paid term of a service (e.g. monthly, yearly or multi-year) beginning on the date payment is confirmed and ending on the stated expiry/renewal date.
- “Remaining Credit” — the unused, pro-rated portion of an amount you have paid for a Session, calculated from the date a failure or termination takes effect to the end of that Session.
2. Acceptance of these Terms
By registering an account, logging in, placing an order, or otherwise using any part of the platform, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any service-specific terms shown at the time of purchase. If you do not agree with any part of these Terms, you must not use the Services.
If you use the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and “you” refers to that entity.
3. Eligibility & Account Registration
- You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and purchase Services.
- You must provide accurate, current and complete information during registration (including a valid email address) and keep it updated at all times.
- You are responsible for maintaining the confidentiality of your login credentials, OTPs, API keys and server passwords. All activity that occurs under your account is your responsibility.
- One person or entity may not maintain multiple accounts for the purpose of abusing free tiers, promotional offers or coupons. We may merge or terminate duplicate accounts.
- We reserve the right to refuse registration, or to suspend new registrations entirely during capacity constraints, at our sole discretion.
4. Description of Services
Anested Cloud is a multi-product cloud platform. The exact specifications, limits and prices of each plan are shown on the relevant product page and at checkout, and form part of your agreement with us.
- Cloud VPS — virtual private servers with root access, dedicated IPv4, and stated CPU, RAM, disk and network transfer allowances.
- Web Hosting — account-level hosting subscriptions: one purchased plan covers your whole account and gates the number of sites, domains and WordPress availability. Each plan includes ONE pooled storage quota (e.g. 2 GB / 50 GB / 100 GB / 200 GB / 400 GB) shared by all site files, automatic site backups and hosting databases together — storage is not allocated per site.
- Hosting databases — MySQL databases included with a Web Hosting plan. Their number is not capped, but each database reserves a minimum of 1 GB of your hosting storage pool (or its real usage, whichever is larger); a new database cannot be created if the pool cannot hold another 1 GB. Hosting databases live in a dedicated “Web Hosting” folder, are governed by the hosting plan (not a database pack), and become read-only when the hosting plan lapses.
- Managed Databases — standalone MySQL, PostgreSQL and MongoDB databases on shared, isolated clusters, purchased separately from Web Hosting. Databases are free to create; pricing is storage-based — you pay for the total storage you provision (in 512 MB steps) beyond the free allowance, with per-database and account-level storage caps as stated on the product page. Standalone databases and hosting databases are separate products with separate quotas — neither counts against the other.
- Nest Storage — object/file storage with API access and public file serving, billed by its own plan quotas. Automatic backups of your hosting sites are stored through Nest Storage in a dedicated hosting-backups area; these backups count against your hosting plan's pooled storage quota and do not require (or consume) a separate Nest Storage plan.
- AI Chatbots — embeddable, knowledge-trained chat widgets billed per bot plan.
- Web Analytics — privacy-friendly site analytics billed per site.
- DNS management — provided free of charge and independent of any paid plan.
We may add, modify or discontinue features at any time. If a discontinued feature materially reduces the value of a Service you have already paid for, Section 8 (compensation) applies.
5. Orders, Pricing, Payments & Billing
5.1 Prices and currency
- All prices are quoted and billed in Indian Rupees (INR ₹) unless expressly stated otherwise.
- An 18% tax/service charge is added to the plan price at checkout and shown separately on your invoice. This is Anested's own service charge — it is NOT GST (Goods and Services Tax). We are not currently GST-registered; our invoices are therefore not GST tax invoices, do not carry a GSTIN, and cannot be used to claim input tax credit.
- If we become GST-registered in the future, GST will be charged as required by law and reflected on invoices from that point onward; this will not retroactively change past invoices.
- We may revise prices at any time. Price changes never affect a Session you have already paid for; they apply from your next renewal or new purchase.
5.2 Payment processing
- Payments are processed by our payment partner (Razorpay). We do not store your full card number, CVV or banking passwords on our servers.
- Certain services (e.g. VPS) may require you to authorise a recurring payment mandate (autopay/UPI mandate) for automatic renewals. A small refundable token charge may be made to verify the mandate and is refunded automatically by the payment gateway.
- An order is confirmed only when the payment is successfully captured and verified. Until then the invoice remains pending and the associated resource is not provisioned.
- Pending, unpaid invoices and their unprovisioned resources may be cancelled by you at any time before payment, and may be automatically discarded by us.
5.3 Invoices and records
- Every purchase generates an invoice visible in your dashboard under Billing. It is your responsibility to review invoices promptly and report discrepancies within 7 days.
- For fraud-prevention we may record the IP address and device information used at the time of payment.
- Failure of a renewal payment (e.g. declined mandate, insufficient funds) may lead to suspension of the affected service as described in Section 9.
5.4 Coupons and discounts
- Coupons are limited-time offers, may carry usage limits, and can be withdrawn at any time before use.
- Coupons cannot be exchanged for cash, credit or refunds, and abuse of coupons (including multi-account abuse) voids the discount and may lead to account termination without refund.
6. Free Tiers & Promotional Credits
- Free plans and promotional credits are provided as-is, with no service guarantee, no uptime commitment and no entitlement to compensation of any kind.
- We may limit, modify, suspend or withdraw a free tier at any time, with or without notice.
- Free resources that remain inactive or abusive may be deleted after reasonable notice to your registered email.
7. Cancellations & Refund Policy
Summary: you may request cancellation and a refund within 7 (seven) days of payment. After 7 days, no cancellation and no refund is possible under any circumstances.
7.1 The 7-day window
- A refund may be requested only within 7 (seven) calendar days of the date and time the payment was made, through the invoice page in your dashboard (Billing → invoice → Request a refund).
- After 7 days, refunds are not available in any case whatsoever — regardless of usage, non-usage, change of mind, technical difficulty on your side, or any other reason. You also cannot cancel a paid Session after 7 days; the Session will simply run until its expiry date.
- The 7-day window applies per invoice/payment. A renewal payment starts its own 7-day window for that renewal only.
7.2 How refunds work
- A refund request is a request, not an automatic refund. Our team reviews every request, typically within 2 business days.
- If approved, everything purchased under that invoice — the server, site, databases, files and all associated data — is permanently deleted. This deletion is irreversible; download anything you need before requesting a refund.
- Approved refunds are issued in full to the original payment method and typically reach you within 5–7 working days of approval, subject to your bank/payment provider.
- Any recurring payment mandate linked to the refunded invoice is cancelled.
- Payment-gateway fees, taxes already remitted, and domain-registration fees (where applicable) are non-refundable to the extent permitted by law.
7.3 When refunds will NOT be issued
- Wrong use / misuse: no refund will be initiated — even within the 7-day window — if the service was used in violation of the Acceptable Use Policy (Section 10), including but not limited to spam, abuse, attacks, illegal content, mining, or resale abuse.
- No refund for accounts or services suspended or terminated for breach of these Terms.
- No refund for free tiers, coupons, promotional credit, or the discounted portion of any purchase.
- No refund where a chargeback or payment dispute has been raised — raising a fraudulent chargeback for services actually delivered is a breach of these Terms and may result in immediate account termination and recovery proceedings.
- No refund for degraded performance caused by your own software, configuration, traffic patterns or third-party services.
8. Failure to Provide a Purchased Server — Our Guarantee
We take delivery seriously. If, for any reason attributable to us, we fail to provide or continue providing a server (or other purchased resource) for a Session you have paid for — for example we cannot provision your VPS, we permanently lose capacity, or we discontinue the service mid-Session — the following applies:
- We will refund the pro-rata value of the used portion adjusted against your payment — i.e. your entire Remaining Credit (the unused portion of the amount paid, calculated day-wise from the date the failure takes effect to the end of the paid Session).
- In addition, we will pay you compensation equal to 10% of that refunded amount as a fine on ourselves, credited together with the refund.
- The total payable is therefore: Remaining Credit + 10% of the Remaining Credit.
- Payment is made to your original payment method (or as account credit if you prefer) within 5–7 working days of the failure being confirmed by our team.
8.1 What does not count as a failure by us
- Suspension or termination caused by your breach of these Terms (including the Acceptable Use Policy).
- Downtime covered by scheduled maintenance announced in advance, or emergency security maintenance.
- Interruptions caused by your own actions — misconfiguration, deleted system files, exhausted resources, unpaid renewals.
- Events of Force Majeure (Section 21) or failures of third-party providers outside our reasonable control, provided we take prompt steps to restore service.
- Temporary outages that are restored within a commercially reasonable time; these do not constitute a failure to provide the Session.
9. Renewals, Expiry, Grace Period & Data Deletion
- Services renew on the schedule you selected. Where an autopay mandate exists, the renewal amount is charged automatically on or shortly before the expiry date.
- If a Session expires without renewal, the service is suspended — servers are stopped, sites stop serving, database connections are refused — but your data is retained.
- For Web Hosting specifically: after expiry your sites stop serving and hosting databases become read-only, but you keep read access to your files and can download your site backups from the dashboard during the grace period.
- If the service is not renewed within 30 (thirty) days of expiry, the service and all associated data are permanently deleted without further notice. Deleted data cannot be recovered.
- Renewing within the 30-day grace period automatically resumes suspended resources. For Web Hosting you may renew the same plan or switch to a bigger one; switching to a smaller plan is only possible if your existing sites and pooled storage usage fit within the smaller plan's limits.
- It is solely your responsibility to keep payment methods valid, watch your registered email, and renew on time.
10. Acceptable Use Policy
You may not use any Service to do, host, transmit, store, distribute or facilitate any of the following. Violation is considered wrong use and results in suspension or termination without refund (Section 7.3):
- Anything illegal under the laws of India or the laws applicable to you — including child sexual abuse material, terrorism-related content, and content infringing intellectual-property rights.
- Sending unsolicited bulk email (spam), SMS bombing, or operating open relays/proxies for abuse.
- Network attacks of any kind — DDoS, port scanning, brute forcing, packet spoofing, botnet command-and-control, or hosting attack tools.
- Phishing, fraud, fake/deceptive websites, malware, ransomware, viruses or exploit distribution.
- Cryptocurrency mining or similar sustained max-CPU workloads on shared or VPS infrastructure, unless expressly permitted in writing.
- Unauthorized access attempts against our infrastructure, other customers, or any third party; interfering with or circumventing platform limits, isolation or billing.
- Hosting content that is defamatory, hateful, or violates the privacy or publicity rights of others.
- Reselling Services in a manner that conceals the end user's identity from us, or using the platform to violate any third party's terms of service.
- Excessive automated abuse of free tiers, trials, coupons or APIs.
We may inspect resource usage patterns (not your private content, except as required by law) to detect abuse. We may report unlawful activity to law-enforcement authorities and cooperate with lawful investigations.
11. Suspension & Termination by Us
Your server or any other Service may be suspended — immediately and without prior notice where the situation demands it — in any of the following circumstances:
- Breach, or reasonably suspected breach, of the Acceptable Use Policy or any other part of these Terms.
- Non-payment, failed renewal, chargeback, or payment reversal.
- Activity that threatens the security, stability or reputation of our infrastructure or other customers (e.g. a compromised server participating in attacks).
- A lawful order, notice or request from a court, government or law-enforcement authority.
- Resource consumption grossly exceeding your plan limits in a way that degrades service for others.
- Where practical, we will notify you at your registered email and give you an opportunity to remedy the issue before or promptly after suspension.
- Suspensions caused by your breach do not extend your Session, do not pause billing, and do not entitle you to any refund.
- Repeated or severe violations result in permanent account termination. Upon termination for breach, all data may be deleted after 7 days (or immediately where required by law), and no refund is payable.
12. Resource Limits & Fair Use
- Each plan carries stated limits (CPU, RAM, disk, storage, bandwidth/transfer, sites, databases, bots, sites tracked, etc.). Limits are enforced technically and contractually.
- Web Hosting storage is ONE pooled quota per account, shared by site files, automatic site backups and hosting databases. When the pool is full, uploads, backups and database writes may be blocked until you free space or upgrade; each hosting database reserves a minimum of 1 GB of the pool.
- “Unlimited” or high-allowance features (e.g. unlimited websites or unlimited database count on Agency/business plans), where offered, are subject to fair use: usage far outside normal patterns for a plan of that size — such as reselling, mass automated site creation, or use as a storage/backup dump — may be throttled or capped after notice. Unlimited sites remain bounded by the plan's pooled storage and per-site CPU/RAM abuse controls.
- Standalone managed databases are capped by the storage you have provisioned (per database and per account pool). Exceeding a database's provisioned storage places it in read-only mode until you resize it or free space.
- Exceeding disk or storage quotas may prevent writes; exceeding transfer allowances may result in throttling or a requirement to upgrade.
- We may move your workload between physical hosts for maintenance or balancing; we aim to do this with minimal disruption.
13. Your Data, Backups & Responsibility
- You own your data. We claim no ownership over the content you host, store or process on the Services.
- You are solely responsible for maintaining your own backups. Unless a plan explicitly includes managed backups, we do not guarantee any backup of your data, and platform-level snapshots (if any) are for disaster recovery of our infrastructure only.
- Data deleted per Section 7 (refund), Section 9 (30-day post-expiry deletion) or Section 11 (termination for breach) is unrecoverable. We are not liable for data loss where these Terms authorised the deletion.
- You are responsible for the legality of the data you store and for obtaining all necessary consents from your own users.
14. Domains & DNS
- DNS zone management on our nameservers is provided free of charge. Free services carry no uptime guarantee or compensation entitlement.
- You must own or control any domain you point at our platform. Attaching domains you do not control is a violation of Section 10.
- Domain registration/renewal (where offered through a partner registrar) is governed additionally by the registrar's terms and ICANN policies, and registration fees are non-refundable once the registry processes them.
15. Security & Credentials
- We implement isolation between tenants and industry-standard safeguards on our infrastructure. However, you administer your own VPS, sites, databases and applications, and you are responsible for securing them (updates, firewalls, strong passwords, key management).
- Server root passwords, database credentials and API keys are shown to you at creation; store them securely. We cannot always recover credentials and may require verification for resets.
- You must notify us immediately at support@anested.com if you suspect unauthorised access to your account.
- You may not conduct security testing (penetration testing, scanning) against our platform without prior written permission. Testing your own VPS internally is permitted so long as it does not affect other tenants or networks.
16. Intellectual Property
- The platform — including its software, design, logos, wordmarks and documentation — is our intellectual property or that of our licensors. These Terms grant you no rights in it except the limited right to use the Services as intended.
- You grant us a limited licence to host, store, cache, transmit and display your content solely as needed to operate the Services.
- If you believe content hosted on our platform infringes your rights, email support@anested.com with sufficient detail; we act on valid notices in accordance with applicable law.
17. Privacy & Data Protection
- We collect and process account information (name, email), billing metadata (invoice history, payment IDs, the IP address and device used at payment) and operational logs, to provide and secure the Services.
- We do not sell your personal data. Payment card data is handled by our payment gateway and never stored on our servers.
- We disclose data only as required by law or a valid order of a court or authority of competent jurisdiction.
- Analytics products we offer to you are designed to be privacy-friendly for your visitors; you remain responsible for your own compliance obligations to your users.
18. Disclaimer of Warranties
Except as expressly stated in Section 8, the Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or completely secure, or that data will never be lost.
19. Limitation of Liability
- To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Services shall not exceed the amount actually paid by you for the affected Service in the 3 (three) months preceding the claim, except where Section 8 expressly provides a higher remedy (Remaining Credit + 10%).
- We are not liable for indirect, incidental, special, consequential or punitive damages — including loss of profits, revenue, business, goodwill or data — even if advised of the possibility.
- We are not liable for content, products or services of third parties, or for your own applications and configurations.
- Nothing in these Terms excludes liability that cannot be excluded under applicable law.
20. Indemnification
You agree to indemnify, defend and hold harmless Anested Cloud, its owners, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of: (a) your use or misuse of the Services; (b) your content or data; (c) your violation of these Terms or of applicable law; or (d) your infringement of any third-party right.
21. Force Majeure
Neither party is liable for delay or failure to perform caused by events beyond its reasonable control — including natural disasters, fire, flood, war, terrorism, riots, labour disputes, power or telecom failures, upstream provider outages, government action, or large-scale internet disturbances. We will use commercially reasonable efforts to restore Services promptly. If a Force Majeure event prevents delivery for more than 30 consecutive days, either party may terminate the affected Service, in which case unused Remaining Credit is refunded (without the Section 8 compensation, which does not apply to Force Majeure).
22. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to any mandatory consumer-law provisions, the courts at Patna, Bihar, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services. Before filing any proceeding, you agree to first contact us at support@anested.com and attempt in good faith to resolve the dispute amicably within 30 days.
23. Changes to These Terms
- We may update these Terms from time to time. The “Last updated” date at the top reflects the latest revision.
- Material changes will be notified via the platform or your registered email at least 7 days before taking effect, where reasonably practicable.
- Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Services; Sessions already paid for remain governed by the refund rules in Section 7.
